marriage settlement (1)〈英〉婚姻财产授予 指婚姻双方当事人之间约定的财产授予〔settlement〕，通常在打算结婚的阶段订立协议，据此，为未来的丈夫、妻子及其子女的利益而对动产或不动产安排授予。此种财产授予协议在将授予财产交与受托人〔trustee〕，并附以创设信托的信托文书〔trust instrument〕时生效。在婚后的财产授予〔post-nuptial settlement〕中也可包含与上述相似的条款。在苏格兰法中，与此相对应的是婚姻合同，包括婚前的婚姻合同〔ante-nuptial marriage contract〕与婚后的婚姻合同〔post-nuptial marriage contract〕。 (2)婚姻财产协议；夫妻财产协议(=marital agreements)
